RESOLUTION - Wednesday, October 09, 2013

We, the Lahore High Court Bar Association condemn the registration of a frivolous case against Mr. Salman Akram Raja, a senior lawyer and a member of the legal fraternity.

The FIR against Mr. Raja has been filed at the behest of
Mr. Jawad S. Khawaja and ordered personally by Iftikhar Muhammad Chaudhry acting as the Chief Justice of Pakistan. This is a clear manifestation of misuse of power by judges of the Supreme Court of Pakistan. Mr. Raja is currently representing Justice Khawajas sister’s family in a case against the wife of justice Khawaja and by getting this FIR, Khawaja and Iftikhar Muhammad Chaudhry have misused their official positions a sitting Judges of the Supreme Court. The actions of Justices Khawaja and Chaudhry amount to gross misconduct and are in sheer violation of the Code of Conduct applicable to judges of the superior courts. Justice Khawaja has attempted to intimidate a legal counsel from performing his professional duty.

The Bar has resolved to stand by Mr. Salman Akram Raja and demand the immediate withdrawal of this frivolous case filed against him.

The Bar has further resolved not to surrender to the autocratic designs of Justices Khawaja and Chaudhry and demand the immediate resignation as well as public apology from both of them.

It is also resolved that any attempt to arrest Mr. Salman Raja or proceedings with the complaint / FIR which is based on malafides will meet the stiffest resistance from the members of the Bar.

An emergent meeting of the General House is convened on 9th October, 2013 under the Chairmanship of Mr. Abid Saqi, President Lahore High Court Bar Association, in order to condemn the registration of a frivolous case against Mr. Salman Akram Raja, Advocate Supreme Court Ch. Ghulam Sarwar Nihung, Vice President LHCBA, M. Baleegh-uz-Zaman Ch. Secretary LHCBA, Usman Sher Gondal Finance Secretary LHCBA and a large number of members of the Bar attended the meeting.

M. Baleegh-uz-Zaman Ch. Secretary LHCBA conducted the proceedings of the meeting. He invited Mr. Hafiz Ansar-ul-Haq, Advocate Supreme Court to recite the verses from the Holy Quran.

M. Baleegh-uz-Zaman Ch. Secretary LHCBA invited Mr. Abid Saqi, President LHCBA to read out his resolution before the House.

M. Baleegh-uz-Zaman Ch. Secretary LHCBA placed the requisition before the House for voting which was approved by thumping majority.

The House is then adjourned.

SEMINAR ON DECONSTRUCTING ARTICLE 175-A OF CONSTITUTION FOR JUDGES APPOINTMENT IN SUPERIOR JUDICIARY - Thursday, September 19, 2013

RESOLUTION

 The Lahore High Court Bar Association expressed dismay over the constitution and working of the Judicial Commission. It is heavily dominated by judges and they remain the sole decision makers in appointment of judges. Further Article 175-A (4) granting the commission powers to make rules regulating its procedure has been misinterpreted  as the rules made to regulate procedure has given sole discretionary powers to the Chief Justice of Pakistan to nominate any name which is presented to the Judicial Commission.

Syed Qalb-e-Hassan Vice Chairman Pakistan Bar Council, Mr. Abid Saqi President Lahore High Court Bar Association, Ch. Muhammad Ahsan Bhoon Member Pakistan Bar Council, Mr. Akhtar Hussain Former Vice Chairman Pakistan Bar Council, Mr. Latif Afridi Former Vice Chairman Pakistan Bar Council, Mr. Azam Nazeer Tarar Member Pakistan Bar Council, Raja Javed Iqbal Secretary Supreme Court Bar Association in a joint press statement showed serious concerns over a news item reported in an American newspaper about an assassination plot of Former Supreme Court Bar of Pakistan President Mrs. Asma Jahangir. They called upon the Govt. of Pakistan for a detailed probe into the allegations and asked for stern action against the actors involved in the plot. They said that Mrs. Asma Jahangir is an asset for lawyers fraternity and voice of oppressed people of this country and any conspiracy against her would be strongly resisted by the lawyers in Pakistan.

Mr. Abid Saqi, President, Chaudhry Ghulam Sarwar Nihang, Vice President, Mr. M. Baleegh Uz Zaman Ch., Secretary and Mr. Usman Sher Gondal, Finance Secretary of the Lahore High Court Bar Association, Lahore in a joint statement endorsed the resolution unanimously passed by the Balochistan High Court Bar Association, Quetta against nomination of disputed lawyers for elevation as additional Judges of Balochistan High Court and Islamabad High Court on Balochistan quota. 

The Office Bearers of the Lahore High Court Bar Association said that the demands of Balochistan High Court Bar Association, Quetta were genuine and based on legitimate demands. They further said that rules framed by the judicial commission whereby majority decision of the members of Judicial Commission were upheld is against the legislative provision contained in Art.175-A of Constitution of Pakistan. That the recent appointments made in the province of Punjab is also clear violation of the above said provisions of the Constitution of Pakistan. They further said that the rules framed by the judicial commission be amended and consensus based decision be taken in the Judicial Commission in future within the spirit of Constitutional provisions. They further strongly demanded that the concerned quarters must redress the grievances of Balochistan High Court Bar Association, Quetta, within the true spirit of the Constitutional Provisions and the demands of lawyers community of Balochistan should be honoured.
